Terms of Service

1. Agreement to Terms

By accessing or using the services provided by GoGold Apps Inc (operating as GoGold Web), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

GoGold Web provides website design, development, hosting, and related digital services to businesses. Our services include but are not limited to:

  • Custom website design and development
  • Website hosting and maintenance
  • Domain registration assistance
  • Website updates and support
  • Custom web applications and automation tools
  • Google Ads management and digital marketing services

3. Payment Terms

Website Development: Payment terms vary based on project scope. For standard website projects, full payment is due before the website goes live. For larger custom projects, a deposit is required before work begins, with the balance due upon completion. All project quotes are provided in writing and must be approved before work commences.

Hosting and Support: Monthly hosting and support services are billed as quoted. Payment is due at the beginning of each billing cycle.

Payment Methods: We accept payment via credit card, debit card, bank transfer, or other methods as agreed upon.

Late Payments: Accounts with payments overdue by more than 30 days may result in service suspension until payment is received.

4. Cancellation and Refund Policy

Website Development: If you cancel before work begins, you will receive a full refund of the setup fee. Once design work has started, refunds are provided on a case-by-case basis depending on work completed.

Hosting Services: You may cancel hosting services at any time with 30 days written notice. No refunds are provided for partial months of service.

Monthly Services: Services such as Google Ads management or ongoing support can be cancelled with 30 days written notice.

5. Client Responsibilities

You agree to:

  • Provide accurate and timely information needed for your project
  • Provide content, images, and text for your website
  • Review and approve designs and content in a timely manner
  • Maintain backups of any critical data
  • Use services in compliance with all applicable laws
  • Not use services for illegal activities, spam, or malicious purposes

6. Intellectual Property and Ownership

Website Code and Design: Upon full payment, you own the rights to the final website design and content you provided. GoGold Web retains rights to any proprietary code, frameworks, or tools used in development.

Portfolio Use: We reserve the right to display completed work in our portfolio unless otherwise agreed in writing.

Third-Party Components: Some websites may include third-party plugins, themes, or services which are subject to their own licenses.

7. Website Hosting and Uptime

We strive to maintain 99.9% uptime for hosted websites. However, we cannot guarantee uninterrupted service due to factors beyond our control including:

  • Server maintenance and updates
  • Internet service provider issues
  • Cyber attacks or security incidents
  • Force majeure events

Scheduled maintenance will be announced in advance when possible.

8. Support and Maintenance

Monthly hosting packages include:

  • Regular backups
  • Security updates
  • Basic content updates (text and image changes)
  • Email and phone support during business hours

Major redesigns, new features, or custom development are quoted separately.

9. Limitation of Liability

GoGold Web will not be liable for:

  • Loss of data, profits, or business opportunities
  • Indirect, incidental, or consequential damages
  • Damages resulting from your use or inability to use our services
  • Third-party actions or services beyond our control

Our total liability for any claim will not exceed the amount you paid for services in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold GoGold Apps Inc harmless from any claims, damages, or expenses arising from:

  • Your use of our services
  • Your violation of these terms
  • Content you provide that infringes on third-party rights
  • Your violation of any applicable laws or regulations

11. Termination

We reserve the right to suspend or terminate services if:

  • You violate these Terms of Service
  • You fail to make required payments
  • You use services for illegal or malicious purposes
  • We determine that continuing service poses a risk to our systems or other clients

Upon termination, you will receive reasonable assistance in transferring your website to another host.

12. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email. Continued use of services after changes constitutes acceptance of the updated terms.

13. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through:

  • Good faith negotiations between parties
  • Mediation if negotiations fail
  • Binding arbitration or small claims court in Ontario, Canada

14. Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.

16. Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and GoGold Web regarding the use of our services.
